B2B REFUND & CANCELLATION POLICY
Brand: KANHA-MED
Proprietor: Roopesh Sachan (SMSPA Enterprises)
As a dedicated B2B platform dealing with pharmaceutical and surgical products, our policies are governed by the Drugs and Cosmetics Act, 1940, and GST regulations regarding “Time Expired Drugs”.
1. CANCELLATION POLICY
- Standard B2B Orders: Cancellations are only permitted before the order is “Dispatched” or within 24 hours of placing the order, whichever is earlier.
- Post-Dispatch: Once products are shipped, cancellations are generally not allowed due to the sensitive nature of medicinal storage and safety requirements.
- Contract Manufacturing: Cancellation is strictly prohibited once the production process or raw material procurement has commenced, as these products are custom-made to your specific branding and formulation needs.
2. RETURN ELIGIBILITY (STRICTLY B2B)
In the pharmaceutical trade, returns are an exception, not a rule. Returns are only accepted in the following cases:
- Wrong Product/Quantity: If the items delivered do not match the Tax Invoice or your registered order.
- Damaged in Transit: If the outer or inner packaging (seals, vials, or bottles) is visibly broken at the time of delivery.
- Requirement: Mandatory unboxing video and immediate written intimation to the delivery personnel and our support team.
- Near-Expiry/Expired Stock: For standard distribution, “Near-Expiry” is defined as medicines having less than 3 months of remaining shelf life at the time of delivery.
- Quality Defect: Suspected manufacturing defects must be reported immediately with batch details for verification by our quality team.
3. NON-RETURNABLE ITEMS
- Temperature-Sensitive Products: Injections, vaccines, and products requiring a cold chain (refrigerated storage) cannot be returned once they leave our controlled environment.
- Opened/Partially Used Stock: Partially consumed strips, opened bottles, or products with damaged labels.
- Incorrect Ordering: Returns requested due to a “change of mind” or buyer’s ordering error are not entertained.
4. REFUND & ADJUSTMENT PROCESS
- Credit Note (Preferred B2B Method): In accordance with Circular No. 72/46/2018-GST, refunds for returned goods are typically issued via a Credit Note. This value is adjusted against your next purchase invoice.
- Bank Refunds: If a refund is approved for a prepaid order that cannot be fulfilled (e.g., out of stock), the amount will be credited to the original payment source within 7-10 working days.
- Verification: All returns are subject to physical inspection. If the Batch Number does not match our invoice records, the return will be rejected.
5. CONTRACT MANUFACTURING REFUNDS
- Refunds for contract manufacturing are limited to manufacturing defects confirmed by lab analysis.
- KANHA-MED/SMSPA Enterprises is not liable for losses due to the client’s failure to market the product or regulatory changes affecting the client’s brand.
